Kenyan socialite and musician, Sheila Wairimu, alias Shay Diva, has been fined KSh 200,000 or to spend four years in jail after being found guilty of stealing a Toyota Landcruiser V8 belonging to her dead lover, Juthalal Dodhia.
The Asian tycoon (Dodhia) was said to be her lover before his death. A day after his demise, Shay Diva accessed the tycoon’s NTSA account and transferred the ownership of the deluxe vehicle to herself.
In a ruling delivered on Monday, December 5, Kitale Chief Magistrate, Julius N’garng’ar, ordered Shay Diva to return the vehicle back to Dodhia’s family.
The 30-year-old was charged with three counts of intermeddling with family Estate, stealing and forgery.
In her mitigation, Shay Diva prayed for a lenient sentence saying her family depends on her, adding that she is the caregiver of her ill mother, who suffers from a heart condition, High blood pressure and diabetes.
“Her mother is a widow and does not have any source of income. My client has four siblings who are all students who depend on her for the basic needs, including one who is seating for this year’s KCSE who is a day scholar,” Shay Diva’s lawyer, David Teti said.
N’garng’ar held that Wairimu (Shay Diva) transferred the vehicle ownership at a very questionable time, a day after Dodhia’s death.
According to NTSA records, she transferred the logbook at 11.45pm on April 26, 2021. The transfer process was successful the following day at 2pm.
Consequently, the tycoon’s family lodged a complaint with the police saying he only gave it to her on a use and return basis since they were in a relationship.
Police officers tracked the socialite to Kitengela, where she stayed. They, in turn, towed the vehicle from her compound to Buruburu Police Station.
TheNewsGuru.com (TNG) reports that the vehicle was later towed to Kitale Police Station, where she was arrested after she tried to retrieve it.
The socialite, however, pleaded not guilty to the charges.
In her defence, she claimed Dodhia gifted her the car before he passed on in April 2021 at age 61. 5, 2022, also ordered the return of the Toyota Landcruiser 200 series back to the family of the late Dodhia Kumar who she was dating.
The judge said: “I have considered the mitigation I will take into account that the accused is a first offender. I have also considered the circumstances under which the offence was committed and the plea in mitigation by the council of the accused.”
