A Lagos High Court, sitting in Ikeja, on Tuesday fixed April 7, 2022 for hearing of all pending application in the suit filed by Mrs Gladys Ndubuisi Kanu against her stepchildren and Nigerian Navy over estate of her late husband, Ndubuisi Kanu.
The hearing of the application was again stalled yesterday due to claimant change of counsel for the eight time.
The trial judge, Justice Christopher Balogun, had on February 7, 2022 fixed yesterday for hearing of pending applications after the claimant in the suit brought an application changed her counsel.
The respondents in the suit are children of the deceased, Kelly Kanu, Nigerian Navy, Simone Abiona (Nee Kanu), Andrey Joe-Ezigbo (nee Kanu), Paula Kanu and Karen Johnson (Nee Kanu), Jeffery Kanu, Laura Kanu, Stephen Kanu and Josephine Ndubuisi Kanu.
On January 31, 2022, when the case came up for hearing after the burial of late Kanu, Mr. O.J. Owoh who represented Mrs Gladys prayed the court for time to study the case file as he was a new counsel in the suit, added that he wanted to file amended claims.
Owoh was the eighth counsel on record before the claimant briefed Dr. Olisa Agbakoba (SAN) Chambers to take over the case yesterday.
The lawyer from Agbakoba Chambers, Udenna Chukwulobe however informed the court that they had just been newly briefed and needed to file a fresh application.
He prayed for a short adjourn date.
In his response, Mr. Tomilade Shodimu led Adeyinka Taiwo representing the 1st, 3rd to 9th respondents in the suit prayed the court for cost as the claimant had stalled hearing as scheduled by the court.
Mr. Shodimu submission was corroborated by Mr. Ben Ijewere counsel to the 10th respondent, noting that the matter could not go on as scheduled due to the claimant changing of counsel and wasting the time of the court.
Justice Balogun in a bench ruling awarded the cost of N40,000.00 for each of the respondents counsel.
When the case was called yesterday, the claimant counsel, Wale Adesokan (SAN) announced his appearance as new counsel for the claimant, prayed the court for time to amend his originating summons.
The court, therefore, adjourned hearing of all pending applications to April 7, 2022.
